| Nothing the courts can do will undo the words harm to his victim, but the courts have to consider the potential for diminished capacity on the part of the perpetrator. His guilt would certainly be more serious if his assault had been premeditated words and he’d been mentally healthy. It seems to me impossible to argue that a PTSD sufferer has undiminished mental capacity and to argue that PTSD is a real and serious psychiatric problem. Of course I’m assuming the rapist has PTSD, and this isn’t just a legal maneuver to get him a lighter sentence.
